This website is operated by DenHaus Paws (“we”, “us”, “our”). By accessing our site and/or using our services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, do not use the site.

We may update these Terms from time to time by posting a revised version on this page. Your continued use constitutes acceptance of the updated Terms.

1. Online Store & Eligibility

By using our Services you represent that you are: (a) at least the age of majority in your state or territory of residence, or (b) have parental/guardian consent for any minor dependents using the site. You must not use the Services for any unlawful purpose or violate any applicable laws. Any breach may result in immediate termination.

2. General Conditions

We may refuse service to anyone for any reason at any time. Other than payment details transmitted via encrypted connections, your content may be transferred unencrypted across networks to meet technical requirements. You must not reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our prior written consent.

3. Accuracy of Information

Materials on the site are provided for general information only and may not be current, complete or accurate. We may modify content at any time without obligation to update.

4. Pricing, Taxes & Changes

Prices are shown in AUD and may change without notice. If applicable, prices include GST unless otherwise stated. We may modify or discontinue products or Services at any time.

5. Products & Colours

Some products may be available exclusively online and in limited quantities. We make reasonable efforts to display colours accurately, but cannot guarantee your device’s display. We may limit sales by person, household, region or jurisdiction.

6. Pre-Orders & Waitlist

From time to time we may offer pre-orders or a waitlist. Pre-order timelines are estimates only and may change due to manufacturing or logistics. We’ll notify you of material delays and you may cancel any unshipped pre-order for a full refund. Joining our waitlist does not guarantee availability or pricing.

7. Orders, Billing & Account Information

We may refuse or cancel any order, limit quantities, or restrict orders placed under the same account, card, billing or shipping address. If we change or cancel an order, we’ll attempt to notify you via the contact details provided. You agree to provide current, complete and accurate information for all purchases and promptly update details as needed.

8. Shipping, Delivery & Risk of Loss (Australia)

We ship via trusted Australian carriers. Delivery dates are estimates only. Risk of loss passes to you upon delivery to the address you provide. Please inspect deliveries promptly and contact us within a reasonable time if something is missing or damaged.

9. Returns, Exchanges & Australian Consumer Law (ACL)

Please review our Return Policy for full details. Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) that cannot be excluded.

If goods are faulty, not of acceptable quality, not fit for purpose or otherwise fail to meet a consumer guarantee, you are entitled to a repair, replacement or refund in accordance with the ACL. For change-of-mind returns (if offered), items must be unused, in original condition and packaging, within the stated timeframe. Customised or used items may not be returnable except as required by law.

10. Safety, Assembly & Use

Always follow our assembly instructions and care guidelines. Use only as intended for household pets. Do not leave pets unattended if they are distressed or likely to chew/ingest materials. Indoor use is recommended unless we explicitly state outdoor suitability. You are responsible for determining whether our products are appropriate for your pet and environment.

11. Optional Tools & Third-Party Links

We may provide access to third-party tools “as is” and “as available” without warranties. Third-party links may direct you to sites we do not control. We are not responsible for third-party materials, websites or transactions. Review third-party policies before engaging with them.

12. User Content, Reviews & Submissions

If you submit reviews, photos, ideas or other content (“User Content”), you grant DenHaus Paws a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, adapt, publish and display the User Content in any media for marketing and operational purposes, subject to our Privacy Policy. You warrant you own or control the rights to your User Content and it does not infringe any third-party rights or contain unlawful material. We may monitor, edit or remove content at our discretion.

13. Intellectual Property

All site content, logos, trademarks, graphics, photos, text and design elements are owned by or licensed to DenHaus Paws and protected by intellectual property laws. You must not use our IP without prior written permission.

14. Prohibited Uses

You must not use the site or Services to: (a) violate laws; (b) infringe IP rights; (c) harass, abuse or defame; (d) upload malware; (e) collect personal data without consent; (f) interfere with security features; (g) scrape or mine data; or (h) perform any activity that, in our sole judgment, is harmful or unlawful.

15. Errors, Inaccuracies & Omissions

Occasionally there may be information that contains typographical errors or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times and availability. We reserve the right to correct and update such information, or cancel orders, without prior notice where permitted by law.

16. Disclaimer of Warranties; Limitation of Liability

Except for any non-excludable guarantees under the ACL, the Services and all products are provided “as is” and “as available.” We do not warrant uninterrupted, secure or error-free use. To the maximum extent permitted by law, DenHaus Paws and its affiliates will not be liable for any indirect, incidental, special or consequential loss, loss of profits, revenue, data or replacement costs arising from your use of the Services or products.

Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, term or condition implied or imposed by the ACL or any other applicable law which cannot be excluded, restricted or modified.

17. Indemnity

You agree to indemnify and hold harmless DenHaus Paws, its officers, employees, agents and affiliates from any claim or demand (including legal fees) made by a third party due to or arising out of your breach of these Terms, your violation of law, or your infringement of any third-party right.

18. Force Majeure

We are not liable for any failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, labour disputes, acts of government, supply chain disruption or carrier delays.

19. Severability

If any provision of these Terms is unlawful, void or unenforceable, that provision is deemed severed and does not affect the validity of the remaining provisions.

20. Termination

These Terms are effective unless and until terminated by either party. We may terminate or suspend access immediately if you breach these Terms. Obligations and liabilities incurred prior to termination survive termination.

21. Entire Agreement

These Terms and any policies posted on the site constitute the entire agreement between you and us and supersede prior agreements regarding the Services.

22. Governing Law

These Terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia.
